Albertans Push Back on No-Fault Auto Insurance: Survey Shows Strong Support for the Right to Sue

As the Alberta government explores changes to the province’s auto insurance system, a newly released survey commissioned by the Canadian Bar Association – Alberta Branch – reveals a strong message from Albertans: they want to keep their right to sue for fair compensation.

The provincial government has been considering a shift to a no-fault insurance model, similar to the one recently adopted in British Columbia. Under such a system, injured individuals would no longer be able to sue for pain and suffering, even in cases where another driver was clearly at fault. Instead, compensation would be “capped” and controlled by insurers.

But Albertans aren’t convinced. The survey shows that:

  • 69% of respondents want to retain their right to take legal action against the at-fault
  • The majority of Albertans are skeptical that a “no-fault system” would result in lower premiums, a key “selling point” touted by proponents.
  • In fact, many said they would rather pay slightly more to preserve their access to justice and the court system.

This public sentiment sends a clear signal: Albertans value fairness, accountability, and the right to be heard. Eliminating the ability to sue may reduce costs for insurers. Still, it comes at the expense of injured victims, those who often face life-altering consequences from collisions caused by others’ negligence.
