A recent article from the Canadian Bar Association – Alberta Branch highlights growing skepticism among Albertans over the province’s proposed move to a no-fault auto insurance model. The key issue? A widespread fear of losing the right to sue negligent drivers.
Under the current tort-based system, victims of motor vehicle crashes in Alberta have the right to pursue fair compensation when someone else’s negligence causes harm. The “proposed no-fault system”—similar to the one implemented in British Columbia—would eliminate that right, replacing it with limited benefits determined by insurance companies, not courts.
Despite promises from insurers and some policymakers that the change will reduce premiums, many Albertans are not convinced. They see it as a cost-saving measure for insurance companies, not a consumer-focused reform. In fact, a public opinion survey found that three out of four Albertans would rather keep their right to sue than accept minor reductions in insurance premiums.
The legal community is also voicing strong concerns. Lawyers warn that “no-fault systems” can lead to under-compensation for serious injuries, especially when those injuries have long-term impacts on work, health, and quality of life.
This debate echoes the recent struggles of accident victims in British Columbia, where B.C.’s “no-fault model,” has created roadblocks to justice for many—including those harmed in catastrophic incidents like pedestrian collisions at festivals and public gatherings.
Bottom line: Albertans want real protection, not just lower premiums. The right to seek fair compensation through the courts is a cornerstone of justice—and it’s a right many don’t want to give up.
